

Decision of the Court of Appeal in Warsaw regarding Allegro’s appeal against the preliminary injunction order in favor of the Forum Konsumentów Foundation
With reference to current report No. 3/2026 dated January 29, 2026, and current report No. 4/2026 dated February 4, 2026, the Board of Directors of Allegro.eu (the “Company”) hereby informs that on July 30, 2026, via the Information Portal of Common Courts (Portal Informacyjny Sądów Powszechnych), it learned that on July 29, 2026, the Court of Appeal in Warsaw (the “Court of Appeal”) issued an order in camera resolving the appeal filed on February 2, 2026, by Allegro sp. z o.o. (“Allegro PL”) against the order of the District Court in Warsaw dated January 26, 2026, granting a preliminary injunction in favor of the Forum Konsumentów Foundation with its registered office in Warsaw (the “Order”).
The Court of Appeal upheld Allegro’s appeal in respect to the method of calculating the financial penalty with which the District Court had threatened Allegro PL in favor of the Forum Konsumentów Foundation in the event of a breach of the obligations specified in the Order. Specifically, the Court provided a precise determination that the penalty applies to each day of breach of the Order and set its maximum amount at PLN 20,000 per day. The Company is satisfied with the clarification of the penalty clause.
The Court of Appeal dismissed the remaining parts of Allegro PL’s appeal, in particular, regarding the required interim changes to the method of presenting delivery options.The dismissal of the appeal in the remaining scope means that the prohibitions and orders imposed for the duration of the proceedings regarding the method of presenting delivery options under the “Allegro Smart!” service in the purchasing process, as described in detail in current report No. 3/2026, remains in force.
The issuance of the decision by the Court of Appeal means that the Order has become final and legally binding, and the suspension of its enforcement, as reported by the Company in current report No. 4/2026, has ceased.
The Company maintains its position that the claims of the Forum Konsumentów Foundation are entirely groundless. The Company emphasizes that the above order concerns solely the matter of interim relief and does not resolve the lawsuit initiated by the Forum Konsumentów Foundation on the merits. The main case will proceed before the District Court in Warsaw, and Allegro PL will take further legal steps to defend its rights in the course of the main proceedings.
