Subject: Delivery to Allegro sp. z o.o. of an order from the District Court in Warsaw granting preliminary injunction in favor of the Forum Konsumentów Foundation with its registered office in Warsaw

The Board of Directors of Allegro.eu (“Company“, “Allegro.eu“) hereby informs that on January 28, 2026, it received notice of the service on 28 January 2026 on Allegro sp. z o.o. (“Allegro PL”) of an order of the District Court in Warsaw dated January 26, 2026, concerning the granting of preliminary injunction in favor of the Forum Konsumentów Foundation with its registered office in Warsaw (“Order“):

1. prohibiting Allegro PL, for the duration of the court proceedings, from displaying in the purchasing process “on the website www.allegro.pl/transakcja/[unique order ID]/zamowienie or the equivalent of this page in the Allegro application, to which the user is transferred after selecting the option “Delivery and Payment” (…) an incomplete list of delivery methods made available by the seller, and from defaulting and highlighting in any way, any delivery method made available by the seller whose offers are covered by the ≪Allegro Smart!≫ service and whose product has been placed by the user in the shopping basket” in the event of placing products in the shopping basket of a value entitling the user to use the “Allegro Smart!” service without incurring a delivery fee,

and

2. ordering Allegro PL, for the duration of the proceedings, to display in the purchasing process “on the website www.allegro.pl/transakcja/[unique order ID]/zamowienie or the equivalent of this page in the Allegro application, to which the user is transferred after selecting the option “Delivery and Payment” (…)all delivery methods made available by the seller whose offers are covered by the ≪Allegro Smart!≫ service and whose product has been placed by the user in the shopping basket, without defaulting or highlighting in any way, any of the delivery methods made available by the seller” in the event of placing products in the shopping basket of a value entitling the user to use the “Allegro Smart!” service without incurring a delivery fee.

Allegro PL has the right to appeal the Order with the Court of Appeal in Warsaw within one week from the day of the Order’s delivery. The Court has given the Forum Konsumentów Foundation two weeks to file a lawsuit in this matter, under pain of the security lapsing.

The Court has threatened Allegro PL with ordering it to pay a financial penalty to the Forum Konsumentów Foundation for violating the obligations referred to in points 1) and 2) above.

The Forum Konsumentów Foundation with its registered office in Warsaw did not contact Allegro PL before filing the application for preliminary injunction.

The Order itself was also issued without Allegro PL being heard. Allegro PL has not yet had the opportunity to present its position.

Allegro PL categorically disagrees with the content of the Decision, which in Allegro PL’s view is entirely groundless, and will take steps to have it overturned in its entirety.

Allegro PL provides a presentation of delivery methods in the purchasing process that complies with legal regulations and meets customer needs, as confirmed by customer satisfaction surveys conducted by Allegro PL. This approach is also consistent with the market standards commonly applied by other market participants.

The described functionalities simplify the purchasing process, whilst still ensuring customers have the full opportunity to make a free decision regarding the choice of delivery method.

Allegro.eu indicates that at the moment this report the Order is enforceable but is not final. The Order will become final only if Allegro fails to appeal, or if the appeal is dismissed by the Court of Appeal.

The interim relief will lapse if the Forum Konsumentów Foundation fails to file a lawsuit within the required deadline.

Allegro.eu will provide updates on further significant stages of the proceedings through separate current reports.
